These terms govern your use of this website and any diagnostic, programme, or advisory service you commission from Fit4Tomorrow Leadership.
These terms apply between Fit4Tomorrow Leadership (KvK 24294108, VAT NL808077053B01) and you, whether you are visiting this website, completing a diagnostic instrument, or commissioning an engagement. By using the site or commissioning work you accept these terms.
We provide organizational diagnostics, leadership programmes, and advisory services. Deliverables are defined in a written proposal or order confirmation for each engagement. Anything not named in that document is out of scope.
Our diagnostics produce an assessment and a set of recommendations. They are an informed professional judgement, not a guarantee of a particular business outcome. Decisions taken on the basis of our work remain yours.
Proposals are valid for 30 days unless stated otherwise and are not binding until countersigned or confirmed in writing. Where an engagement is delivered in phases, each phase is commissioned separately.
Fees are as stated in the proposal or on the relevant product page, exclusive of VAT unless stated otherwise. Unless agreed differently, engagements are invoiced 50% on commissioning and 50% on completion of the phase. Payment terms are 14 days from the invoice date. Late payment entitles us to suspend delivery and to charge statutory interest and reasonable collection costs.
Digital products purchased through the website are payable in advance and are made available immediately on payment.
If you purchase as a consumer, you have a statutory 14-day right of withdrawal. For digital content made available immediately, that right lapses once delivery begins and you have acknowledged this — which is why we ask you to confirm it at checkout.
Purchases made in a professional or business capacity are not covered by the consumer right of withdrawal. Where a scheduled session is cancelled, cancellation terms are set out in the relevant proposal.
Our work depends on the accuracy of what you tell us. You agree to provide the information, access, and participation the engagement requires, and to make available the people whose involvement the proposal identifies. Delays caused by unavailability may affect timing and cost.
Both parties treat commercially sensitive information received from the other as confidential and use it only for the purpose of the engagement. Individual assessment responses are treated as confidential to the individual; aggregate findings are reported to the commissioning client.
All instruments, models, frameworks and materials — including the Friction Scan, Leadership OS Score, Play2Win, Fit4Tomorrow, Lean5Sigma, Wired2Stay AI, the Fit4Scan and the Blueprint for Success — remain our intellectual property. You receive a non-exclusive, non-transferable right to use the deliverables inside your own organization. You may not resell, license, publish, or reproduce them for third parties without written permission.
Reports and outputs prepared specifically for you are yours to use internally as you see fit.
Our liability for any engagement is limited to the fees invoiced for that engagement, and in any event to the amount covered by our professional liability insurance. We are not liable for indirect or consequential loss, including lost profit, lost savings, or business interruption. Nothing in these terms excludes liability for intent or gross negligence.

Neither party is liable for failure to perform caused by circumstances beyond its reasonable control. Where such circumstances persist, either party may suspend or terminate the engagement, with work delivered to that point remaining payable.
These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, unless we agree in writing to resolve the matter by mediation first.
